Objector
A class member who challenges a proposed settlement at the fairness hearing.
Objectors serve a legitimate structural function in testing settlements no one else has an incentive to contest, though the practice has attracted a well-documented strand of opportunistic objection. Rule 23(e)(5) now requires court approval for payment in exchange for withdrawing an objection.
