Opt-Out Class

A Rule 23(b)(3) class whose members may exclude themselves and preserve individual claims.

Members who opt out are not bound by the judgment or settlement and retain the right to sue individually. Large opt-out populations in mass torts create parallel individual inventories and are one of the pressure points that global settlements are designed to close.
