Vacatur
Judicial annulment of an arbitral award on narrow statutory grounds.
The FAA permits vacatur for corruption, evident partiality, misconduct in refusing to hear material evidence, or an arbitrator exceeding their powers. The grounds are deliberately narrow, and courts do not review awards for legal error — which is why so much mass arbitration litigation happens at the front end, on the enforceability of the clause, rather than at the back end.
