JAMS
A major US provider whose mass arbitration procedures apply only by express agreement.
JAMS issued Mass Arbitration Procedures and Guidelines effective May 2024, triggered at seventy-five claimants represented by the same or coordinated counsel regardless of dispute type. The defining feature is consent: unlike the AAA regime, the JAMS procedures apply only where the parties have expressly adopted them, which limits their usefulness as a defensive tool for any company that did not name them in advance.
