Design Defect

A claim that the product's design itself was unreasonably dangerous.

Assessed under a risk-utility test, a consumer expectations test, or both depending on the jurisdiction, usually requiring proof of a reasonable alternative design. Design claims survive some preemption arguments that defeat warning claims, which shapes pleading strategy across an inventory.
