Mass Arbitration

Aggregate Settlement (Mass Arbitration)

Global resolution of a mass filing inventory, typically at a fraction of the administrative fee exposure.

Because fee exposure accrues before merits are reached, respondents frequently settle inventories for less than the fees they would otherwise pay — a dynamic that decouples settlement value from claim merit in both directions. Reported resolutions have run into the tens of millions of dollars covering populations in the millions, following demand inventories in the tens of thousands.
