Aggregation is the economic engine common to class actions, MDLs, and mass arbitration. An individual claim worth a few hundred dollars will never be litigated on its own; ten thousand of them, held by one firm, become a portfolio with real settlement value. Mass arbitration achieves aggregation without a procedural aggregation device, by exploiting the per-claim cost structure of arbitration itself.
