Punitive Damages
Damages awarded to punish and deter rather than compensate.
Available where conduct is shown to be malicious, oppressive, or in reckless disregard of safety, subject to state caps and constitutional limits on the ratio to compensatory damages. Punitive exposure in bellwether verdicts is a principal driver of inventory-wide settlement valuations.
