Retainer Agreement
The engagement contract between claimant and counsel.
In mass practice, retainers are executed at volume through digital intake, which raises real questions about informed consent, the scope of authority to settle, and whether the claimant has any relationship with counsel beyond a signature. Aggregate settlement rules require individual informed consent that volume intake makes difficult to demonstrate.
