Mass Arbitration

Mass Filing Threshold

The number of similar demands that triggers a provider's mass arbitration rules.

Providers apply their mass regimes only above a numeric trigger. The AAA's mass rules reach twenty-five or more similar demands in the consumer and employment context, with a higher threshold outside it; JAMS applies a single seventy-five-claimant trigger regardless of dispute type. Thresholds matter tactically in both directions — claimants' counsel may stage filings to stay beneath a trigger, and respondents draft to pull filings above one.
